India’s Industrial Design Law
India’s design law seeks to balance the protection of registered designs with the encouragement of creative activity. Designs that are fresh , creative and visually appealing are protected by design law.
The owner of a registered design gains a substantial business advantage. Before a product is commercialised or put on show in public, a registration application for the design must be submitted. Ownership may be revoked for prior commercialization or public exhibition.
Obtaining design registration is comparatively faster than obtaining other types of intellectual property. A design is protected for ten years, during which it may be further extended for an additional five.
The Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) and the Paris Convention for the Protection of Industrial Property are both ratified by India.

To stop infringement of a registered design, the owner of the registered design may bring a civil lawsuit seeking an injunction. There are no legal remedies available for crimes.
