Original works of drama, music, art, cinematography, sound recordings, and much more are protected by the Indian Copyright Act. Although it is not required, copyright registration is advised for several types of works in order to improve enforcement. Since India is a party to many international agreements, such as the Berne Convention, works made by foreign people in Convention countries are also entitled to copyright rights.
Both copyright common law and legislation have recently seemed to be pulling in different directions, with courts interpreting copyright’s less burdensome and limited exclusivity and legislation aiming to secure more rights for the right holder. Nevertheless, rights holders have and will continue to face increasingly difficult hurdles in preserving and upholding copyright in the digital age.
